Legalistička doktrina i protopravo u staroj Kini

Abstract
U članku autor pokušava da ukaže na vezu između učenja tzv. legalizma (fa čia) i zakona (fa) u kineskoj državi Č'in (u periodu zaraćenih država) i u Kini (za vreme dinastije Č'in). Ovaj zakon ne treba shvatiti kao pravo u evropskom smislu reči (tj. kao primenu formalne logike na formulaciju normi, praćenu nastojanjem da se balansira društvena moć), već kao jednu vrstu protoprava (tj. kao 'univerzalni obrazac kažnjavanja', regulisan od strane apsolutnog i svetovnog vladara). Doktrina legalizma (koju su razvijali Šang Jang, Han Fej i drugi) predstavljala je stvarnu konceptualnu osnovu za rano kinesko pravno ustrojstvo. Kao i ostale kineske doktrine u to vreme, legalizam je glavni socijalni problem video u problemu raspada sklada između reči i stvari. Ali, umesto da nastoje da taj problem reše sredstvima tradicionalnog poretka (kao što su to činili konfučijanci), legalisti su težili koncentraciji apsolutne društvene moći u rukama vladara, koji je slobodan da tu moć upotrebi prema sopstven...om nahođenju.

In the article the author endeavors to explain the connection between the teachinpref so-called legalism (fa chia) and the law (fa) in chinese state of Ch'in (in the period of Warring States) and in China (during the Ch'in dynasty). This law should not be understood as the law in the European sense (i.e. as an application of the formal logic to the formulation of norms, accompanied by the attempt to balance social power), but as a kind of proto-law (i.e. as an 'universal punishing pattern', regulated by the absolute and secular ruler). Legalist doctrine (developed by Shang Yang, Han Fei and others) was genuine conceptual basis for the early Chinese legal constitution. Like the other Chinese doctrines in that time, legalism treated the dissolution of the harmony between words and things as the main social problem. But, instead of trying to solve this problem by means of traditional order (like the confucianist did), the legalists sought to concentrate the social power in the hands of ab...solute ruler, who is free to use this power for his own sake.
